Business and Professions Code (Bus. & Prof. Code) section 26013 grants the Department of Cannabis Control (DCC) the authority to adopt rules and regulations as may be necessary to implement, administer, and enforce its duties under the Medicinal and Adult-Use Cannabis Regulation and Safety Act (MAUCRSA) (Bus. & Prof. Code, section 26000 et seq.) The rules and regulations adopted by the DCC shall be consistent with the purposes and intent of the Control, Regulate and Tax Adult Use of Marijuana Act. (Bus. & Prof. Code section 26013(a).)
Pursuant to MAUCRSA, the DCC adopts and enforces rules and regulations for commercial cannabis license holders in California, including cultivators, retailers, manufacturers, distributors, testing laboratories, microbusinesses, and temporary cannabis events. Regulations adopted by the DCC follow the rulemaking procedures and standards established by the Administrative Procedure Act (Government Code, section 11340 et seq.) as well as the Office of Administrative Law (Cal. Code Regs., tit. 1, sections 1 through 280).
